1. Purpose and identification
This document (General Conditions of Sale) defines the conditions applicable to sales concluded between, on the one hand, persons wishing to make a purchase via the MEDUSE website https://www.meduse.com/, hereinafter referred to as "the customer" and, on the other hand, the company HUMEAU BEAUPREAU SAS with a capital of 737,344 euros, whose registered office is located at 80 rue des Forges, Beaupréau, 49600 Beaupréau en Mauges, France, registered with the RCS in Angers under number 393 092 390, hereinafter referred to as "MEDUSE".
These conditions only concern non-commercial natural persons who have the status of consumers within the meaning of Community Regulation No. 1215/2012 of the European Parliament, Section 4, Article 17.
2. Order
The Customer may order online via the website https://www.meduse.com/. The order implies irrevocable acceptance of these general terms and conditions of sale. These general terms and conditions of sale may be subject to change; the applicable conditions are those in effect on the website https://www.meduse.com/ on the date the order is placed. The order can only be registered on the website if the user has clearly identified themselves by entering their customer code (corresponding to their email address) and a chosen password. Any order is only taken into account after acceptance of payment. After acceptance of payment, MEDUSE will confirm the order to the Customer by email, assigning a number to it.
3. Product availability
Any order implies acceptance of the prices and description of the products available for sale.
MEDUSE undertakes to honor orders received on the website only within the limits of available product stocks. If one or more ordered products are unavailable, MEDUSE undertakes to inform the customer as soon as possible. The customer's order will then be automatically canceled in whole or in part and their credit card will be automatically re-credited with the amount of the order or the returned product(s).
4. Delivery
Delivery is made according to the provisions mentioned below, depending on the delivery area in which the Customer requests delivery.
Any order placed on the MEDUSE website before 11 a.m. from Monday to Thursday (excluding public holidays) will be prepared and shipped within 48 hours, subject to payment validation (see paragraph 5. Payment). Orders placed on a Friday, Saturday, Sunday or public holiday (excluding Ascension Day weekends) will be processed on the next business day.
No partial deliveries will be made.
4.1. Delivery to mainland France and Corsica (zone 1)
The Customer can choose from the following paid delivery methods
Chronopost tracking with 2 options:
- Express home delivery, next day delivery before 6 p.m. (if ordered before 11 a.m.)
- Delivery to a collection point; delivery will be free for purchases over €70.
4.2. Delivery to Europe and non-Europe
Countries in the Europe zone
The Customer can choose from the following paid delivery methods:
- Chronopost delivery to a relay point; this service will cost 15.00 euros including tax for a package up to 2 kg; 20.00 euros including tax for a package up to 5 kg; if the package weighs more than 5 kg, you will need to choose the DHL option.
- DHL home delivery or delivery to a relay point between 4 and 5 days; this service will be charged 25.00 euros including tax for a package up to 5 kg; 30.00 euros including tax for a package up to 10 kg; 40.00 euros including tax for a package up to 15 kg; if the package weighs more than 15 kg, the order cannot be completed and the customer will have to contact Méduse to find out the exact price of transporting their package.
Countries outside Europe
- DHL home delivery or delivery to a relay point between 4 and 5 days; this service will be charged 25.00 euros including tax for a package up to 5 kg; 30.00 euros including tax for a package up to 10 kg; 40.00 euros including tax for a package up to 15 kg; if the package weighs more than 15 kg, the order cannot be completed and the customer will have to contact Méduse to find out the exact price of transporting their package.
ATTENTION :
Customs duties or other taxes or import duties may be payable upon entry of Méduse products into the State in which the Customer is a resident. These duties and taxes, whatever their nature and name, are not the responsibility of Méduse. The Customer must therefore inform himself of the obligations provided for in this respect by the legislation and regulations of the State concerned and will be required to fulfill, with all competent institutions, administrations and organizations, all obligations, in particular declarations and/or payment, relating to the products he has ordered.
5. Payment
Payment for purchases is made by credit card: Visa, MasterCard, Eurocard MasterCard, Apple Pay or Paypal, secured by 3D Secure.
6. Right of withdrawal
In accordance with the provisions of Article L.121-21 of the French Consumer Code, the Customer has a period of 14 days to exercise their right of withdrawal without having to provide a reason. The starting point of the period is the day the order confirmation is received by the Customer or the third party designated by them. If the 14-day period expires on a Saturday, Sunday, or a public holiday, it is extended until the next working day.
To exercise his right of withdrawal, the Customer must notify MEDUSE of his decision to withdraw, before the expiry of the period.

The Customer can return the item to the address HUMEAU BEAUPREAU, meduse.com, 80 rue des Forges, Beaupréau, 49600 Beaupréau en Mauges, France.
The Customer must enclose the duly completed return slip with the package (slip attached when sending the package) as well as the withdrawal form indicating the order number.
In the event of a return of the entire order, the Customer will be reimbursed for the initial delivery costs, with the exception of additional costs resulting from the choice of a delivery method other than the less expensive standard delivery method offered by MEDUSE in accordance with the legislation.
Partial returns of some of the products ordered will result in a refund of the returned product(s). The initial delivery costs will not be refunded because the amount of shipping costs is a fixed amount and does not depend on the number of products ordered.
Return costs are the sole responsibility of the Customer.
The refund will be made within 14 days following the date on which MEDUSE was informed by the Customer of their decision to withdraw. In any event, this refund cannot be made before MEDUSE has recovered the item(s) subject to the Customer's withdrawal or provided proof of return of the latter.
The refund will be made by bank transfer.
Reimbursement will not be possible if the item in question has suffered depreciation resulting from handling other than that necessary to establish its nature, characteristics and/or conformity.
7. Returns
7.1. Deadline for returning an item
The Customer has 15 working days from the date of receipt of the goods to return the item(s) that do not suit them at their own expense, subject to compliance with the conditions set out below.
7.2. Return conditions
We only offer refunds.
- Complete the return slip provided with your order.

7.3. Condition of products
All returned products (shoes, original packaging, accessories, instructions, etc.) must be new, unused and in their original box, intact and without writing.
Upon receipt of the package, MEDUSE will assess the condition of the returned merchandise. No returns will be accepted, and therefore no refunds will be issued, if the returned products have been visibly used or damaged by the customer.
7.4. Reimbursement
In the event of a return complying with the conditions mentioned above, MEDUSE will reimburse the returned products no later than 15 days following the return of the goods.
The initial shipping costs will not be refunded, unless the return was due to non-conformity of the products or an error in the products delivered compared to those ordered by the Customer.
The refund will be made by bank transfer.
7.5. Legal guarantees
7.5.1 Legal guarantee of conformity
The products benefit from the legal guarantee of conformity (article L 217-1 to L 217-32 of the Consumer Code) and the guarantee of hidden defects (article 1641 et seq. of the Civil Code).
Any warranty is excluded in the event of damage of external origin or resulting from misuse, improper use, negligence or lack of maintenance on the part of the Customer, as in the event of normal wear and tear of the product.
Legal guarantee of conformity
- The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
- The legal guarantee of conformity gives the consumer the right to have the goods repaired or replaced within thirty days of their request, free of charge and without any major inconvenience to them.
- If the product is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
- If the consumer requests the repair of the goods, but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund upon return of the goods, if:
The professional refuses to repair or replace the goods;
4°The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity
The repair or replacement of the goods takes place after a period of thirty days;
The repair or replacement of the good causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of recovery or removal of the non-compliant good, or if he bears the costs of installation of the repaired or replacement good;
The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the good or to the termination of the contract when the lack of conformity is so serious that it justifies an immediate reduction in the price or termination of the contract. The consumer is then not required to request the repair or replacement of the good beforehand.
- The consumer is not entitled to cancel the sale if the lack of conformity is minor.
- Any period of immobilization of the property for the purpose of repair or replacement suspends the warranty which remained to run until delivery of the repaired property.
- The rights mentioned above result from the application of articles L.217-1 to L.217-32 of the consumer code.
- A seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of the average annual turnover (c. consum. art. L. 241-5 ).
7.5.2 Legal guarantee of hidden defects
The buyer also benefits from the legal guarantee against hidden defects under the conditions recalled below.
Article 1641 of the Civil Code
The seller is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.
Article 1648 paragraph 1 of the Civil Code
The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.
When deciding to implement the guarantee against hidden defects in the item sold within the meaning of Article 1641 of the Civil Code, the Customer may choose between cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.
7.6 Terms of return and reimbursement of defective or non-compliant products
The guarantor for defects in the item sold is SAS HUMEAU BEAUPREAU.
The Customer requesting the benefit of the legal guarantee of conformity or hidden defects must then return the item within the aforementioned time limits to MEDUSE at the following address:

Prior to this return, the Customer must contact Web Customer Service at 02.41.63.90.43 (non-premium rate call). Web Customer Service will send the Customer a return slip which must be included with the package.
In the event of a defective or non-compliant product being returned, after MEDUSE has noted the defect or non-compliance of the product, MEDUSE will reimburse the Customer for the price of the item(s) concerned, the return costs, and, in the event of the entire order being returned, the shipping costs, or Méduse will proceed with an exchange if the product is available.
8. Price
MEDUSE reserves the right to modify its prices on the site at any time without notice.
Products will be invoiced based on the rates in effect at the time the order is placed. Products remain the property of MEDUSE until full payment has been received.
9. Securing transactions
MEDUSE implements all means to ensure the confidentiality and security of data transmitted on the web and on the website https://www.meduse.com/. As such, the website uses a secure 3D Secure payment module.
10. Intellectual Property
All elements of the MEDUSE website, whether visual or audio, are protected by copyright, trademarks, or patents. HUMEAU BEAUPREAU SAS holds ownership or a contractual right to use them. As such, and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code. Any total or partial reproduction of the MEDUSE website is strictly prohibited without prior agreement.
11. Personal data
All personal data concerning the Client that will be collected by HUMEAU BEAUPREAU SAS are used by the latter in accordance with the provisions of European Regulation No. 2016/679 of April 27, 2016, known as the General Data Protection Regulation (GDPR). All useful information is given on the website https://www.meduse.com/
Humeau Beaupréau SAS uses "cookies" in accordance with the GDPR and with Directive 2009/136/EC of the European Parliament and of the Council of 25 November 2009 and will comply with all provisions of legislation and regulations that will be issued in the future regarding this use.
12. Liability
HUMEAU BEAUPREAU has, for all stages of access to the site and the ordering process, only an obligation of means. MEDUSE cannot be held liable for any inconvenience or damage inherent in the use of the internet network, in particular a breakdown in service, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with case law.
Furthermore, the company HUMEAU BEAUPREAU cannot be held responsible in the event that the order is not completed or if it is prevented from fulfilling any of its obligations due to a case of force majeure as defined by case law, and in particular in the event of a strike or bad weather preventing the delivery of the order.
13. Entirety
In the event that one of the clauses of these General Conditions of Sale is null and void due to a change in legislation, regulation or a court decision, this shall in no way affect the validity and compliance with the other clauses of these General Conditions of Sale.
14. Duration
These conditions apply for the entire duration that the services offered by MEDUSE are online.
15. Proof
The computerized records, stored in the computer systems of MEDUSE and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.
16. Storage and archiving of transactions
The archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with article 1348 of the civil code.
17. Dispute Resolution
17.1 Applicable law; contract language
In the event that the Client is a French citizen, the applicable law will be French law. The French version of these General Terms and Conditions will be the only valid one and will be the sole authority for the rights and obligations of the parties.
In the event that the Client is not a French citizen, the applicable law will be determined by the regulations of the European Union if the Client is a citizen of a Member State thereof or by the applicable international treaty in the event that the Client is a citizen of any other State. Whenever possible under applicable law, the valid version which will be the sole authentic version of the rights and obligations of the parties will be the English language version.
17.2 Procedure and jurisdiction
Regardless of the citizenship of the Client, any dispute that may arise between HUMEAU BEAUPREAU SAS and the Client may possibly be submitted to the online dispute resolution procedure and brought before the platform ec.europa.eu/consumers/odr using the link below:

In the event that the dispute cannot be settled on this platform, HUMEAU BEAUPREAU SAS or the Client may refer the matter to the competent court in accordance with the provisions of the Code of Civil Procedure if they are a French citizen or in accordance with the provisions of European regulations if they are a citizen of a Member State of the European Union or in accordance with the provisions of the applicable international treaty if they are a citizen of any other State.
17.3 Consumer mediation
In the event of a dispute between the professional and the consumer, they will endeavor to find an amicable solution.
In the absence of an amicable agreement, the consumer has the option of contacting the consumer mediator responsible for the professional, namely the Association of European Mediators (AME CONSO), free of charge, within one year of the written complaint sent to the professional.
The referral to the consumer mediator must be made:
- either by completing the form provided for this purpose on the AME CONSO website: www.mediationconso-ame.com ;
- either by mail addressed to AME CONSO, 11 Place Dauphine – 75001 PARIS.
